Terms of Service

To use the Platform, you must:

• Be at least 18 years of age;
• Be a resident of India and legally able to enter into a binding contract;
• Provide accurate, current, and complete information about yourself; and
• Use the Platform only for lawful purposes and in line with these Terms.

The Platform and its features are currently offered in Bengaluru, India, and availability may vary by location.

Owne is a facilitator and marketplace for a zero-interest, rent-to-own approach to home ownership. We connect home buyers who propose plans on curated properties with investors who choose to fund them, and we provide tools to review, structure, and manage those arrangements.

Owne is not a bank, lender, broker-dealer, or investment adviser. Nothing on the Platform is investment, tax, legal, or financial advice, an offer or solicitation to buy or sell any security, or a recommendation that any plan or investment is suitable for you.

Figures shown on the Platform — including home values, monthly amounts, target returns, and projections — are illustrative only, may rely on assumptions, and are not guarantees. Real estate involves risk; values can fall as well as rise and returns are not guaranteed. You should obtain independent professional advice before making any financial decision and rely on your own judgement.

You access the Platform using your phone number and a one-time passcode (OTP). You are responsible for keeping access to your phone number and OTP secure, and for all activity that occurs under your account.

• Do not share your OTP with anyone. Owne will never ask you for it.
• Notify us immediately at support@owne.in if you suspect unauthorised use of your account.
• Each account is single-role (buyer or investor) and is intended for a single individual. You must not impersonate anyone or misrepresent your identity.

If you use the Platform as a home buyer, you agree to:

• Provide accurate identity (including PAN) and financial information, including income, existing obligations, and proof of funds where requested;
• Propose plans in good faith and only for amounts you can reasonably afford;
• Understand that proposing a plan does not guarantee that it will be approved, matched, or funded; and
• Comply with the specific terms of any plan or agreement you enter into, which will govern that transaction.

If you use the Platform as an investor, you agree to:

• Complete identity and suitability checks and provide accurate information, including proof of funds where requested;
• Make your own assessment of each opportunity and understand that returns are illustrative and not guaranteed, and that capital is at risk;
• Only commit funds that are lawfully yours and that you can afford to place at risk; and
• Comply with the specific terms of any funding arrangement you enter into.

Owne may charge fees for use of the Platform or particular services. Where fees apply, they will be disclosed to you before you incur them. Payments are processed by our third-party payment provider (see Section 8); by making a payment you also agree to that provider's terms.

Applicable taxes may be added. Unless required by law or stated otherwise, fees are non-refundable. The financial terms of any specific plan or transaction are set out in the agreement for that transaction.

Property information on the Platform — including descriptions, images, pricing, location data, and any reports or estimates — is provided for general information and is illustrative. While we curate listings and aim for accuracy, we do not warrant that any listing is complete, current, or error-free, and details are subject to change and independent verification.

You are responsible for content you submit (for example, documents and property preferences). You confirm that you have the right to share it, that it is accurate, and that it does not infringe anyone's rights or any law. We may remove content that violates these Terms.

The Platform relies on third-party providers, including Supabase (database, authentication, and storage) and Razorpay (payment processing). Your use of features powered by these providers may be subject to their terms and privacy policies. We are not responsible for the acts or omissions of third-party providers, and links to third-party sites are provided for convenience only.

You agree not to:

• Use the Platform for any unlawful, fraudulent, or harmful purpose;
• Attempt to gain unauthorised access to the Platform, other accounts, or our systems, or interfere with their operation or security;
• Submit false, misleading, or fraudulent information; or
• Copy, scrape, reverse-engineer, or exploit the Platform or its content except as expressly permitted.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Platform or other users.

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Owne disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any plan will be approved, matched, funded, or achieve any particular outcome.

To the maximum extent permitted by law, Owne and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Platform.

To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Platform will not exceed the total fees you paid to Owne for the service giving rise to the claim in the twelve (12) months before the event. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

You agree to indemnify and hold harmless Owne and its officers, employees, and partners from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Platform, your content, or your breach of these Terms or applicable law.

These Terms are governed by the laws of India. Subject to applicable law, the courts at Bengaluru, Karnataka, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Platform, and you consent to that jurisdiction.

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you in the app. Your continued use of the Platform after an update means you accept the revised Terms.
